Terms of Service

These terms apply to use of this website and to sourcing engagements with China Buying Desk, alongside the written scope agreed for your engagement.

Services

China Buying Desk provides China-side sourcing support, supplier benchmarking, supplier verification and commercial screening, negotiation support, sample coordination, supplier visits and purchasing coordination.
Each engagement is defined in writing before work begins, including the deliverable, the exclusions and the fee. Work outside that written scope is quoted separately.
China Buying Desk acts as an independent service provider. It is not your agent for contracting purposes, is not a party to your purchase agreements with suppliers, and does not take title to goods.

Fees are quoted as a fixed price for a defined scope, or as separately quoted work for larger engagements. The China Supplier Benchmark Sprint is a fixed fee of $750 for one defined product and up to three suppliers.
There is no public checkout on this website. Payment instructions are provided in writing once an engagement is confirmed.
Fees are for professional work performed, not for a guaranteed commercial outcome. Sample costs, sample freight, third-party inspection, testing, freight, duties, tariffs and supplier payments are the client's responsibility unless expressly agreed otherwise in writing.

You are responsible for providing accurate product specifications, quantities, customization requirements and timing.
You are responsible for your own purchasing decisions, contracts with suppliers, payments to suppliers, import compliance, product compliance and end-customer commitments.
You confirm you have the right to share any specifications, drawings, artwork or trademarks provided to us.

China Buying Desk does not guarantee supplier performance, product quality, production capacity, regulatory approval or certification, customs classification or clearance, delivery dates, freight outcomes, pricing outcomes, cost savings or sales results.
Supplier verification and commercial screening is a commercial review based on information reasonably available from China at the time of the work. It is not a factory audit, laboratory test, certification, credit report, or legal or compliance opinion.
Recommendations, including KEEP, RENEGOTIATE, SAMPLE, SWITCH and DO NOT PROCEED, are professional opinions to support your decision. The purchasing decision remains yours.

To the maximum extent permitted by law, China Buying Desk is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost sales, loss of goodwill, production delays, supplier default, shipment delays, customs outcomes, tariff changes or business interruption.
To the maximum extent permitted by law, total aggregate liability arising out of or relating to an engagement is limited to the fees actually paid to China Buying Desk for that engagement.
Nothing in these terms excludes liability that cannot lawfully be excluded.

Each party will treat the other's non-public commercial information as confidential and use it only for the engagement. A mutual non-disclosure agreement can be signed on request.
You retain ownership of your specifications, artwork and trademarks. Deliverables prepared for you may be used within your business, and may not be resold or published as a standalone product.

Either party may decline further work. Fees for work already performed remain payable.
These terms may be updated. The version in effect when your engagement is confirmed governs that engagement.
Any dispute will be resolved on an individual basis, and the written engagement terms control where they conflict with this page.
